I thought about that one. If your opponent takes the long route and you take the short route. You are essentially on the same course. Just as the course of a great river may surround many islands. I.e. the road adopts a tortuous course along the coast.

3. The finish is when the Pursuer quits the course.

I do not think you are quitting the course when you take a short cut. Your intent is clear enough, you are still in the race.

As long as the leader does not turn off before the junction. When he gets back on the road, you are in front. You are the leader. You now can choose the remaining course.

I mean like when you are in front you have to choose your roads well enough so that, that cannot happen to you. Because if it does you will no longer be in front when they get back on the road ahead of you.

This really becomes a problem when you get so far in front that you do not know if the pursuer reentered the road behind you or not. “I have waited.”

But if they know about the other road, they know that they do not have a clear victory when they see you turn off on to it. And you know you have a win, when nothing goes wrong on your sidetrip, whether the former leader knows it or not. It’s mental but it definitely can be a win for you, and uncertainty for the pursuer.

In any case your taking the short cut spoiled their possible win.
