    Is a verbal agreement legal in georgia?

    I done a roof for someone and they have not payed me yet we had a verbal agreement I put a lien on ther house today but I guess I need to take them to small claims court . So is the verbal agreement legal in Georgia?

    Well im not sure but i bought a car from a guy when i was 16 and we made a verbal agreement that i paid him 1800 for the car on time till it was paid ,at the end of me paying it off he decides that he wanted intrest and wasnt giving me the title untill i gave him the intrest ,So i took him to court and the judge asked if he made the agreement that i had stated he says yes ,and she said give him his title then theres nothing else to be said .so i guess it would be his word against yours unless he says that you both agreed on it.

    Always make sure you get jobs in writing, even if you do the services and then hand write an invoice for it. All he has to do is claim that he didn't say anything to you about what you are asking for and then it becomes a small claims pissing match between your word and his. If you have at least an invoice the Judge can sit there and look at it and think "Well, he didn't just come up with this invoice for the hell of it."

    As far as the legalities of it or not, I don't know, but if I were you I would print up some sort of invoice or bill stating what was agreed up on and get him to sign it.

    If he didn't pay, I would just tear his shingles back off! Then atleast I would have the satisfaction of laughing when it rains!

    My Dad took a guy to court over a verbal agreement, all he had to show was the receipts where he had purchased everything. Dad won, and the judge awarded that guys truck to my dad also.

    With a business transaction, a verbal agreement is a verbal contract. The problem is if nothing was written down, it's hard to prove what was agreed upon.

    Always have a written and signed agreement with anyone you're conducting business with.

    not sure about GA.

    My father owns a roofing company in Nashville and I can remember people not paying and him just moving on to the next job, but I can also remember tearing off on friday what we put on on moday for a guy that told my dad he was stupid for doing the work without payment first and that he would never get a dime from him.

    When the cops got there and asked what we were doing, Dad said Repo work. The cop laughed and left.

    Agreement

    the question that you should be asking is is the agreement binding. in Tn oral contracts are binding but I would always at least have a witness but in writing is always best. Dan

    I talked to a judge here in rome and he said that a verbal is good in ga plus he asked me how many days I was on the house I told him 3 days and than he said would u let someone on your house for 3 day if they were not supose to be there so I feel better

    I did the same "Deal" with a HVAC system... I had installed 5 HVAC systems for a contractor.

    And the "Contractor" tells me after about 3 days of call dodging I should give him this system. Then he goes on to tell me the Law of "Real Property".....

    I go on to tell him how 2 Hoggs dispose of a Dead body and 3 are real fast about it. I come to my senses contact my Attorney who calls the "Contractor" on speaker with a Judge on speaker phone. Of coorse Genisis gets smart with everyone. And the Judge instructed us and the contractor along with a Shierffs Deputy for a Witness to resolve this. We went and Repoed the unit even after the "Contractor" offered to pay. Jus figured it would be easier to not have to worry about the Warrenty and Liablity, thank God we permited the Job. It was the first thing the Judge ask us about.

    I think its called Theft of Service?

    I won the case but only because the guy was a dumbass but a verbal agreement is no good in the state of georgia all the guy had to do was say we had no verbal agreement but he told the judge we had a agreement but that he thought the insurance was paying for it
